General Terms and Conditions
This page sets out the conditions for using the HostGuard service.
The following conditions apply to the use of the HostGuard service.
Service
HostGuard (operated by APPON LINE Kft.) is a service-monitoring (uptime-monitoring) service run from an external server: it periodically checks the availability and response time of the website(s)/service(s) specified by the user and, optionally, the expiry of their SSL certificate, and notifies the user by e-mail and/or SMS in the event of an outage/recovery. Optionally, using a health-agent script that can be installed on the user's own server, it can also collect infrastructure-level (disk/memory/load) metrics.
The service is monitoring only; HostGuard does not access or modify the monitored systems (the health-agent likewise returns read-only metrics).
Plans and pricing
HostGuard is available in the following subscription plans, with different domain limits, check frequencies and SMS allowances:

The SMS quota is a hard limit: once the monthly allowance is exhausted, further alerts are delivered by e-mail only until the allowance renews in the next billing cycle. The prices above are net prices; the applicable value added tax (currently 27% VAT) is added to them on the invoice when the service is used.
Payment and invoicing
The fee for paid plans is charged monthly by bank card (via the Stripe payment provider). HostGuard does not store card data; payment is processed on Stripe's PCI-DSS certified system.
Plan changes: an upgrade takes effect immediately, and the difference is settled on a pro-rata basis (according to the remaining days, rounded down). A downgrade takes effect from the turnover date of the next billing cycle.
Failed charge: if the charge of the monthly fee fails, HostGuard will attempt to charge the account again within a grace period; if this is unsuccessful, the paid features (domains beyond the allowance, SMS, health-agent) may be suspended until the debt is settled or the user switches back to the free plan.
HostGuard issues an electronic invoice for every successful charge via the szamlazz.hu service, based on the billing details provided by the user.
Cancellation
The user may cancel the subscription at any time, without justification, in their account; the cancellation ensures access to the paid features until the end of the current billing cycle, after which the account automatically switches to the free plan (or — at the user's choice — the account is deleted via the self-service deletion process). As a business (B2B) service, HostGuard does not provide a refund for the already paid, current billing period; the cancellation ensures access until the end of the paid period, and no pro-rata refund is available before that.
Liability
HostGuard provides the monitoring service to the best of its knowledge, but without guaranteed availability; for any indirect or direct damage arising from a possible outage of the service, a delayed alert or an erroneous measurement, the data controller's liability is limited to the greatest extent permitted by law and may not exceed the amount of the subscription fee paid by the user in the given month. HostGuard is not responsible for the operation, security or content of the monitored systems — this is the sole responsibility of the user.
The installation and operation of the health-agent script on the user's own server is at the user's own responsibility; HostGuard makes the script's source code publicly available for the purpose of verifiability.
Amendment
HostGuard reserves the right to unilaterally amend these Terms and Conditions, in particular in the event of a change in legislation or an expansion of the service's features. Users will be notified of any material amendment by e-mail at least 15 days before the amendment takes effect. The Terms and Conditions in force at any given time are available on the Website.
Governing law
These Terms and Conditions are governed by Hungarian law, in particular the provisions of Act V of 2013 on the Civil Code and Act CVIII of 2001 on certain issues of electronic commerce services and information society services. In the case of a user qualifying as a consumer, the mandatory (cogent) provisions of consumer protection legislation (in particular Act CLV of 1997 on consumer protection) take precedence over these Terms and Conditions.
